1. Introduction

These Terms of Service govern your use of the Vibe and Trip route planning web service ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. Eligibility

• Users must be 16 years or older.
• The Service is not for use while driving or in hazardous conditions.
• The Service is not intended for emergency navigation.

3. Account Responsibility

• Users are responsible for maintaining the confidentiality of their passwords.
• Account sharing is prohibited.

4. Acceptable Use

Prohibited: scraping, attacks, misuse, attempts to de-anonymize data.

5. User Content and Data Rights

Users retain all rights to the personal content they provide, such as account information and saved routes. By using the Service, users grant Vibe and Trip a limited, non-exclusive, worldwide, and royalty-free license to process their ratings, preferences, and route data strictly for the purpose of:

• Providing and personalizing travel itineraries (contract necessity);
• Improving the quality and performance of the Service (with user consent where required by law);
• Developing future AI models using aggregated or de-identified data, only if the user has provided explicit consent.

This license is revocable at any time by deleting your account or withdrawing consent (where applicable). Users are prohibited from attempting to re-identify any individuals from anonymized or aggregated datasets.

6. Limitation of Liability

• Service provided "as-is" without warranties of accuracy or availability.
• Indirect or special damages are excluded. Nothing in this section shall limit your mandatory consumer rights under EU, UK or US law.
• Liability cap: fees paid in the last 12 months (or $100 if free service).

7. Termination

Vibe and Trip may suspend or terminate accounts for violations. Certain provisions survive termination (rights to data, license grants) including sections on liability, governing law, and dispute resolution.

8. Governing Law and Dispute Resolution

Governing law: Armenia. Optional arbitration/forum selection at Vibe and Trip discretion. Mandatory consumer rights under EU, UK, or US law are not waived.

9. DMCA / Notice-and-Takedown

If user-generated content exists, Vibe and Trip will follow DMCA notice-and-takedown procedures.

10. Updates

Vibe and Trip may update these Terms. Users will be notified via website or email.
